Driver arrested on felony assault charge reinstated

The TLC suspended suspended Richard Gray after he was arrestd on a felony assault charge following an argument with a neighbor. The police report said that Gray damaged the complainant’s ring camera and doorknob to her apartment and threw “a 5 pound dumbbell with intent to cause serious physical injury. The complainant was hospitalized. 

Nevertheless, the OATH judge considered that the off-duty conduct occurred while the driver was off-duty and was impressed by Gray’s character witnesses. The driver himself offered credible and unrebutted testimony that he has never received a passenger complaint or had a conflict with a driver in the one-and-a-half year of being a driver. That testmony included attestations of Gray’s strong work ethic and his calm and friendly disposition toward co-workers and passengers.
